Terms of Service.

1. Services Provided

Potomac Roofing LLC provides residential roofing services throughout Virginia, including but not limited to: roof inspections, roof repair, full roof replacement, storm damage assessment, and insurance claim assistance.

The specific scope of services for each project will be outlined in a written estimate or contract provided to you prior to the start of work.

2. Estimates and Pricing

• All estimates are provided free of charge and are valid for 30 days from the date of issue unless otherwise stated in writing.
• Estimates are based on visible conditions at the time of inspection. Additional work discovered during the project may result in revised pricing, which will be communicated and approved by you before proceeding.
• Final pricing may vary based on material availability, permit requirements, and the actual scope of work performed.

3. Scheduling and Access

• Project start dates are approximate and may be affected by weather, material availability, permit processing, or other factors beyond our control.
• You agree to provide reasonable access to the work area, including clear pathways, vehicle access for equipment, and authorization for our crew to perform the agreed-upon work.
• If access is restricted or conditions differ significantly from the initial assessment, we reserve the right to adjust the timeline or scope of work.

4. Payment Terms

• A deposit may be required before work begins, as specified in your contract or estimate.
• Final payment is due upon completion of the project unless alternative payment terms have been arranged in writing.
• We accept payment by check, credit card, or bank transfer.
• Late payments may be subject to a service charge of 1.5% per month on the outstanding balance.

5. Warranties

Potomac Roofing LLC stands behind our workmanship. Details of our warranty coverage will be provided in writing as part of your project contract.

• Workmanship warranties cover defects in installation and labor performed by our crew.
• Material warranties are provided by the manufacturer and are separate from our workmanship warranty. We will assist you in filing any manufacturer warranty claims.
• Warranties do not cover damage caused by severe weather events, falling trees or debris, unauthorized modifications, neglect, or failure to perform reasonable maintenance.

6. Insurance Claims Assistance

We offer assistance with insurance claims for storm damage and other covered events. You acknowledge that:

• We are not an insurance company or licensed insurance adjuster. Our assistance is limited to documenting damage, providing estimates, and coordinating with your insurance adjuster.
• Approval and payment of insurance claims is at the sole discretion of your insurance company.
• You are responsible for any deductible, non-covered amounts, or differences between the insurance payout and the actual cost of repairs.

7. Client Responsibilities

You agree to:

• Provide accurate information about your property, including known issues, HOA requirements, and any relevant permits or restrictions.
• Secure pets, vehicles, and personal property near the work area prior to the start of the project.
• Notify us promptly of any concerns during the project.
• Make timely decisions regarding material selections, color choices, and change orders to avoid project delays.

8. Permits and Compliance

We obtain all necessary building permits and ensure that our work complies with local building codes and regulations. Permit fees are included in the project estimate unless otherwise noted. We are fully licensed and insured to perform roofing work in Virginia.

9. Limitation of Liability

• Our total liability for any claims arising from our services shall not exceed the total amount paid by you for the specific project in question.
• We shall not be liable for any indirect, incidental, or consequential damages, including loss of use of property, unless caused by our gross negligence or willful misconduct.
• We are not responsible for pre-existing structural issues, hidden damage discovered during the project (which will be communicated to you for approval), or damage caused by events beyond our control.

10. Cancellation and Termination

• You may cancel a project prior to the start of work. If materials have already been ordered, you may be responsible for restocking fees or non-refundable material costs.
• Once work has begun, cancellation will require payment for all work completed and materials used up to the date of cancellation.
• We reserve the right to suspend or terminate work if payment terms are not met or if unsafe conditions are discovered on the property.

11. Dispute Resolution

Any disputes arising from these Terms or our services shall be resolved as follows:

• The parties shall first attempt to resolve the dispute through good-faith negotiation.
• If negotiation is unsuccessful, the dispute shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
• Arbitration shall take place in the Commonwealth of Virginia.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia, without regard to its conflict of law provisions.

13. Modifications

We reserve the right to update these Terms at any time. The updated version will be posted on our website with a new "Last updated" date. Continued use of our services after modifications constitutes acceptance of the updated Terms.
